This Privacy Policy outlines how JD Software ("JD Software") collects, uses, and shares your information, as well as the choices available to you regarding this information.
Scope of This Privacy Policy
This Privacy Policy applies to JD Software’s products and services, including mobile and desktop
applications (collectively referred to as the “Services”), www.jdsoft.com, other JD Software websites
(collectively referred to as the “Websites”), and other interactions you may have with JD Software, such
as customer service inquiries or participation in user conferences. If you do not agree with the terms
outlined here, please do not access or use the Services, Websites, or any other aspect of JD Software’s
operations.
This Privacy Policy does not cover any third-party applications or software that integrate with the
Services through the JD Software platform (“Third-Party Services”), nor does it apply to any other thirdparty products, services, or businesses. A separate agreement governs the delivery, access, and use of
the Services (the “MSA”), including how data submitted through the Services (“Service Data”) is
processed. The organization (e.g., your employer or another entity or individual) that agreed to the MSA
(“Customer”) controls its instance of the Services and any associated Service Data (the “Customer
Instance”).
Information JD Software Collects and Receives
JD Software may collect, generate, and receive Service Data and other information (collectively referred
to as “Information”) in several ways:

Service Data: Customers and individuals granted access to a Customer Instance by a Customer (“Authorized Users”) may submit Service Data when using the Services.

Account Information: To create or update a JD Software account, you or a Customer (e.g., your
employer) may provide JD Software with an email address, phone number, password, domain,
and other similar account details. Additionally, Customers purchasing a paid version of the
Services will provide billing details such as credit card information, banking information, and/or a
billing address to JD Software or its payment processors.

Services Metadata: When an Authorized User interacts with the Services, metadata is generated
that offers additional context about the way Authorized Users engage with the Services. For
instance, JD Software logs which Third-Party Services are connected to the Services, if applicable.

Log Data: Our servers automatically collect information when you access or use our Websites or
Services, recording it in log files. This log data may include the Internet Protocol (IP) address, the
address of the web page visited before accessing the Website or Services, browser type and
settings, the date and time the Services were accessed, browser configuration and plugin
information, language preferences, and cookie data.

Device Information: JD Software collects data about devices accessing the Services, including
the device type, operating system used, device settings, application IDs, unique device
identifiers, and crash data. The extent of the information collected often depends on the type of
device used and its settings.

Location Information: JD Software may receive information from you, your Customer, and other
third parties that help approximate your location. For example, JD Software may use a business
address provided by your employer or an IP address obtained from your browser or device to
determine an approximate location. JD Software may also collect location information from
devices according to the consent process provided by your device.

Cookie Information: JD Software uses cookies and similar technologies on our Websites and
Services to help collect Other Information. These Websites and Services may also include cookies
and similar tracking technologies from third parties, which may collect Other Information about
you through the Websites and Services and across other websites and online services. For more

to JD Software’s Cookie Policy.

Third-Party Services: A Customer can connect Third-Party Services to its Customer Instance.
Typically, Third-Party Services are software services that integrate with JD Software Services, and
a Customer can permit its Authorized Users to enable and disable these integrations within its
Customer Instance. JD Software may also develop and offer JD Software applications that
connect the Services with a Third-Party Service. Once enabled, the provider of a Third-Party
Service may share certain information with JD Software. For example, if a single sign-on service is
connected with JD Software, JD Software may receive the username and email address of
Authorized Users, along with additional information that the application has elected to make
available to JD Software to facilitate the integration. Authorized Users should review the privacy
settings and notices in these Third-Party Services to understand what data may be disclosed to
JD Software. When a Third-Party Service is enabled, JD Software is authorized to connect and
access Other Information made available in accordance with permissions granted by Customer
(including by its Authorized User(s)). JD Software does not, however, receive or store passwords
for any of these Third-Party Services when connecting them to the Services.

Contact Information: Authorized Users may be required to provide certain contact information
(e.g., an email address) when creating an account on the Services.

Third-Party Data: JD Software may receive data about organizations, industries, customer lists,
website visitors, marketing campaigns, and other business-related matters from affiliates,
subsidiaries, partners, or other entities with whom JD Software engages to enhance JD
Software’s own information. This data may be combined with Other Information collected by JD
Software and might include aggregate-level data, such as which IP addresses correspond to
specific zip codes or countries, or more specific details, such as the performance of an online
marketing or email campaign.

Additional Information Provided to JD Software: JD Software may receive Other Information
submitted to our Websites or through other means, such as participation in a focus group,
contest, activity, or event, applying for a job, enrolling in an educational program hosted by JD
Software or a vendor, requesting support, interacting with our social media accounts, or
otherwise communicating with JD Software.
How JD Software Uses Information
JD Software uses Service Data in accordance with the applicable MSA, Customer’s use of Services
functionality, and as required by law. JD Software acts as a processor of Service Data, while the Customer
is the controller.
JD Software also uses Information to support our legitimate interests in operating our Services, Websites,
and business. Specifically, JD Software may use Information to:

Provide, update, maintain, and protect our Services, Websites, and business. This includes using
Service Data and Other Information to support the delivery of Services under an MSA, prevent or
address service errors, security, or technical issues, analyze and monitor usage, trends, and other
activities, or respond to an Authorized User’s request.

Comply with applicable laws, legal processes, or regulations.

Communicate with you by responding to your requests, comments, and questions. If you contact
us, JD Software may use your Information to respond.

Develop and provide additional features. JD Software strives to make the Services as useful as
possible for Customers and Authorized Users. JD Software may use aggregated and anonymized
Service Data and Other Information to develop new Services or enhance existing ones.

Send emails and other communications. JD Software may send you service, technical, and other
administrative emails, messages, and other communications. JD Software may also contact you
to inform you about changes to our Services, Services offerings, and important Services-related
notices, such as security and fraud alerts. These communications are considered part of the
Services, and you may not opt out of them. Additionally, JD Software may send emails about
new product features, promotional content, or other news about JD Software. These are
marketing messages, and you have control over whether you receive them. If you have any

mechanisms described below.

Manage billing, account management, and other administrative matters. JD Software may need
to contact you regarding invoicing, account management, or similar matters. JD Software uses
account data to manage accounts and track billing and payments.

Investigate and help prevent security issues and abuse.
If Information is aggregated or de-identified so that it is no longer reasonably associated with an
identified or identifiable natural person, JD Software may use it for any business purpose. If Information
is associated with an identified or identifiable natural person and is protected as personal data under
applicable data protection laws, it is referred to in this Privacy Policy as “Personal Data.”
Data Retention
JD Software retains Service Data in accordance with the applicable MSA, Customer’s use of Services
functionality, and as required by law.
JD Software may retain Other Information for as long as necessary for the purposes described in this
Privacy Policy. This may include retaining Other Information for the time required to pursue legitimate
business interests, conduct audits, comply with (and demonstrate compliance with) legal obligations,
resolve disputes, and enforce agreements.

We retain customer data following account termination unless deletion is requested by the
customer.

We retain website visitor information collected through cookies for a period of 2 months, in line
with the retention settings configured in Google Analytics.
How JD Software Shares and Discloses Information
This section describes how JD Software may share and disclose Information:

Displaying and Operating the Services: Due to the inherent nature and functionality of the
Services, Information will be visible to Authorized Users within a Customer Instance as part of the Service operation.

Third-Party Service Providers and Partners: JD Software may engage third-party service
providers or business partners to process Information and support our business operations.
These third parties may, for example, provide virtual computing and storage services. When
necessary and applicable, these third-party service providers and partners will be bound by
appropriate and commercially reasonable confidentiality obligations

Third-Party Services: Customers may enable or permit Authorized Users to enable Third-Party
Services. JD Software requires each Third-Party Service to disclose all permissions for
information access in the Services, but JD Software cannot guarantee they do so. When enabled
and as requested by the Customer, JD Software may share Information with Third-Party Services.
Third-Party Services are not owned or controlled by JD Software, and third parties granted
access to Information may have their own policies and practices for data collection, use, and
sharing. Please review the permissions, privacy settings, and notices for these Third-Party
Services or contact the service provider with any questions.

Corporate Affiliates: JD Software may share Information with its corporate affiliates, parent
companies, and/or subsidiaries.

During a Business Change: If JD Software undergoes a merger, acquisition, bankruptcy,
dissolution, reorganization, sale of some or all of its assets or stock, financing, public offering of
securities, acquisition of all or part of its business, or similar transaction or proceeding, some or
all Information may be shared or transferred, subject to appropriate and commercially
reasonable confidentiality arrangements.

Aggregated or De-Identified Data: JD Software may disclose or use aggregated or de-identified
Information for any purpose. For instance, JD Software may share aggregated or de-identified
Information with prospects or partners for business or research purposes.

Compliance with Laws: If a law enforcement or government agency requests Information about
a Customer, JD Software will attempt to redirect the agency to request the data directly from the
Customer. As part of this effort, JD Software may provide the Customer’s basic contact
information to the law enforcement or government agency. If compelled to disclose Information
to a law enforcement or government agency, JD Software will notify the Customer of the
demand and provide cooperation to allow the Customer to seek a protective order or other
appropriate remedy unless legally prohibited from doing so. JD Software will not voluntarily
disclose Information related to a Customer to any law enforcement or government agency unless
required by public authorities, including to meet national security or law enforcement
requirements.

Enforcing Rights, Preventing Fraud, and Ensuring Safety: JD Software may disclose Information
to protect and defend its rights, property, or safety, as well as that of third parties. This includes
enforcing contracts or policies and investigating and preventing fraud or security issues.

With Consent: JD Software may share Information with third parties when JD Software has
received consent to do so.
Security
Security is a critical component of JD Software’s mission, and we take the security of your data seriously.
JD Software uses industry-standard technical and organizational measures to protect Information from
loss, misuse, and unauthorized access or disclosure. These measures account for the sensitivity of the
Information JD Software collects, processes, and stores, as well as the current state of technology.
However, due to the nature of communications and information processing technology, JD Software
cannot guarantee that Information under our care will be absolutely safe from intrusion during
transmission over the Internet or while stored on our systems. When you click a link to a third-party site,
you will be leaving our site, and JD Software does not control or endorse the content on third-party sites.
Age Limitations
JD Software’s Services and Websites are not intended for use by anyone under 16 years old. If JD
Software learns that someone under 16 has unlawfully provided Personal Data, we will take steps to
delete that information.
Changes to This Privacy Policy
JD Software may update this Privacy Policy from time to time to reflect changes in laws, regulations,
industry standards, or our services or business practices. We will post any changes to this page and
encourage you to review our Privacy Policy regularly to stay informed. If we make changes that
materially alter your privacy rights, JD Software will provide additional notice, such as via email or
through the Services. If you disagree with the changes to this Privacy Policy, you should stop using the
Services. If you wish to request the removal of Personal Data under a Customer’s control, please contact
the applicable Customer.
Identifying the Data Controller and Processor
Data protection laws in certain jurisdictions differentiate between the “controller” and “processor” of
information. Generally, the Customer is the controller of Service Data, while JD Software is the processor
of Service Data and the controller of Other Information.
